4.3 Pricing and Payment

Prices for our Services are as stated on our Site or as quoted directly to you. All prices are in Euros unless otherwise specified. Prices may change at any time, but changes will not affect confirmed bookings.

Payment terms will be specified in your booking confirmation. For most bookings, we require a deposit at the time of confirmation, with the balance due before the performance date.

4.4 Cancellations and Rescheduling

Our cancellation and rescheduling policies are as follows:

• Cancellation by You: If you need to cancel a confirmed booking, please notify us as soon as possible. Refunds will be processed according to our Refund Policy.
• Rescheduling by You: Requests to reschedule a confirmed booking are subject to availability and may incur additional fees.
• Cancellation by Us: In rare circumstances, we may need to cancel or reschedule a performance due to animal welfare concerns, performer illness, extreme weather, or other unforeseen circumstances. In such cases, we will offer you the option to reschedule or receive a full refund.

We reserve the right to make minor modifications to the performance content if necessary for animal welfare or logistical reasons. Significant changes will be communicated to you as soon as possible.

5. User Conduct and Responsibilities

5.1 General Conduct

When using our Site or Services, you agree to:

• Comply with all applicable laws and regulations
• Respect the rights and dignity of others
• Follow all instructions provided by SKLNSMOTKEY staff during performances
• Not engage in any activity that could harm our animals, staff, or other attendees

• Not use flash photography or loud devices that may disturb the animals
• Supervise any children in your care at all times

6. Intellectual Property and Content

6.1 SKLNSMOTKEY Content

Unless otherwise indicated, the Site and all content and materials on the Site, including logos, trademarks, images, text, graphics, illustrations, and photographs (collectively, "SKLNSMOTKEY Content"), are owned by or licensed to SKLNSMOTKEY and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and SKLNSMOTKEY Content for personal, non-commercial purposes.

6.2 User Content

By attending our performances, you acknowledge that you may be photographed or recorded by SKLNSMOTKEY staff, and you consent to the use of your likeness in promotional materials.

7. Disclaimers and Limitations of Liability

7.1 Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SKLNSMOTKEY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

7.2 Inherent Risks

You acknowledge that attending animal performances involves inherent risks. While we take all reasonable precautions to ensure the safety of our audiences, we cannot guarantee that accidents will not occur. By attending our performances, you assume all risks associated with such attendance.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SKLNSMOTKEY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE
• ANY CONTENT OBTAINED FROM THE SITE
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OUR SITE OR SERVICES.

9.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall first be resolved through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in accordance with the mediation rules of the German Institution of Arbitration (DIS). If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in Berlin, Germany.

9.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.

9.4 Entire Agreement

These Terms constitute the entire agreement between you and SKLNSMOTKEY regarding the use of the Site and Services, superseding any prior agreements between you and SKLNSMOTKEY relating to your use of the Site or Services.

9.5 Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
